1. AGREEMENT TO TERMS

By downloading, installing, or using the RealShield AI mobile application or website (realshieldai.com) (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and RealShield AI, LLC. You must be at least 13 years of age to use this Service. By using the Service, you represent that you meet this age requirement.

2. DESCRIPTION OF SERVICE

RealShield AI provides AI-powered probabilistic analysis of digital media — including images, audio recordings, and short video clips — to help users assess whether content may have been artificially generated or manipulated using AI tools ("deepfakes").

  • Advisory Tool Only: The "Shield Score" produced by our Service is a probabilistic estimate based on AI analysis. It is not a guarantee, a legal certification of authenticity, or a definitive determination of truth or falsity.
  • Not a Legal or Forensic Service: RealShield AI is not a licensed forensic service and our outputs should not be used as the sole basis for legal, financial, or law enforcement decisions. Always exercise independent judgment.
  • No Warranty of Accuracy: AI detection technology is imperfect. False positives (flagging real content as AI-generated) and false negatives (missing AI-generated content) can and do occur. RealShield AI does not warrant 100% detection accuracy.
  • "As-Is" Basis: The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied.

Return Evidence Verification Disclaimer

RealShield AI provides Return Evidence Verification as an AI-powered decision-support tool. Our platform delivers authenticity insights based on media analysis to assist merchants in their internal review processes; however, it does not constitute legal, financial, or final expert advice.

Merchants retain full, exclusive authority and responsibility for all business decisions — including the approval or rejection of customer refund or return requests — made in connection with the use of our services. RealShield AI does not guarantee the accuracy, completeness, or reliability of its AI-detection results.

By using this service, you acknowledge that RealShield AI shall not be held liable for any financial, operational, or reputational losses, including but not limited to incorrect refund determinations, resulting from your reliance (or lack of reliance) on any analysis provided by the platform.

3. ACCOUNT REGISTRATION

To access most features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and account credentials
  • Notify us immediately of any unauthorized use of your account at support@realshield.ai
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe are being used fraudulently.

4. SUBSCRIPTIONS, BILLING & CANCELLATION

A. Subscription Plans

RealShield AI uses a shared credit system across all scan types (photo, voice, and video). We offer three monthly subscription tiers: Essential ($4.95/month, 5 credits), Plus ($9.95/month, 15 credits), and Premium ($24.95/month, 40 credits). A photo or voice scan costs 1 credit; a video scan costs 1-4 credits depending on clip length, since longer clips require more analysis (video uploads are capped at 12 seconds). Monthly credits reset each billing cycle and do not roll over. Plan features and pricing are described on our pricing page and are subject to change with advance notice.

B. Credit Packs

Users may also purchase one-time credit packs (available in 1, 3, 5, 10, or 20-credit increments), in addition to or independent of a monthly subscription. Purchased credits never expire and are only spent once your monthly allotment (if any) is exhausted.

C. Free Tier

New users receive one (1) free lifetime scan. A subscription or credit pack purchase is required after that free scan is used.

D. Auto-Renewal

All subscriptions automatically renew at the end of each billing period (monthly) unless cancelled before the renewal date. By subscribing, you authorize RealShield AI (or Apple/Google, if purchased through their platforms) to charge your payment method on a recurring basis.

E. Cancellation

You may cancel your subscription at any time through your account settings or through the App Store / Google Play settings if purchased through those platforms. Cancellation takes effect at the end of your current paid billing period. You will retain access to the Service, including any remaining monthly credits, until that date.

F. Refunds

For subscriptions and purchases made directly through our website (realshieldai.com), all fees are non-refundable except where required by applicable law.

For purchases made through the Apple App Store or Google Play Store, refunds are governed entirely by Apple's and Google's respective refund policies. RealShield AI has no control over and is not responsible for refund decisions made by these platforms. To request a refund for an App Store or Google Play purchase, contact Apple or Google directly through their standard support channels.

G. Taxes

RealShield AI, LLC is a Delaware company; Delaware imposes no state sales tax. For subscriptions and credit packs purchased through the Apple App Store or Google Play Store, any applicable sales, VAT, or similar tax is calculated, collected, and remitted by Apple or Google directly, as required under their respective marketplace facilitator obligations — RealShield AI does not separately collect tax on these purchases. For purchases made directly through our website, applicable tax (if any) is calculated and collected at checkout based on the purchaser's location.

5. ACCEPTABLE USE & PROHIBITED CONDUCT

You agree to use RealShield AI only for lawful purposes. You agree NOT to:

  • Use the Service to analyze, process, or distribute non-consensual intimate imagery (NCII) in violation of the federal TAKE IT DOWN Act or any applicable state law
  • Use outputs from RealShield AI to harass, defame, stalk, or infringe upon the rights or privacy of any individual
  • Attempt to reverse-engineer, stress-test, or probe deepfake creation tools using our Service in order to improve their ability to evade detection
  • Circumvent, disable, or interfere with any security features of the Service
  • Attempt to bypass API rate limits, scrape data, or access our systems through unauthorized means
  • Use the Service for illegal surveillance or to monitor any individual without their explicit consent
  • Resell, sublicense, or commercially exploit the Service without our written permission
  • Upload content that you do not have the legal right to submit for analysis

Violation of these provisions may result in immediate account termination and may expose you to civil or criminal liability.

6. MEDIA UPLOADS & BIOMETRIC CONSENT

A. Content You Upload

By uploading audio, images, or video to RealShield AI, you represent and warrant that:

  • You own the content or have the legal right to submit it for analysis
  • Submission of the content does not violate any third party's rights, including privacy, copyright, or intellectual property rights
  • The content does not constitute non-consensual intimate imagery (NCII)

B. License Grant

You grant RealShield AI a limited, non-exclusive, non-transferable license to process your uploaded content solely for the purpose of providing you with the requested analysis. This license terminates when your content is deleted from our systems (within 24 hours for static uploads).

C. Biometric Data Consent

Our Service analyzes voice and facial characteristics in uploaded media to detect AI manipulation. By using the analysis features, you expressly consent to this processing for deepfake detection purposes only. You may withdraw this consent at any time by discontinuing use of the analysis features.

For Illinois residents: Consistent with the Illinois Biometric Information Privacy Act (BIPA, 740 ILCS 14), you will be presented with a separate, explicit biometric consent screen within the app before any biometric data is collected or processed. Your consent to these Terms does not substitute for that required disclosure.

D. Live Monitoring

When you activate Live Call Monitor features (where available), you grant RealShield AI a limited license to process real-time audio and video streams. All live stream data is processed ephemerally in volatile memory and purged immediately after generating a Shield Score. No live stream audio or video is recorded or stored.

7. DATA HANDLING & THIRD-PARTY PROCESSORS

A. Data Minimization

RealShield AI adheres to a data minimization philosophy. Static media files are retained for a maximum of twenty-four (24) hours for analysis purposes and then permanently deleted. We retain only your Shield Score, scan metadata (file type, size, date), and account information. See our Privacy Policy at realshieldai.com/privacy for full details.

B. Third-Party Detection Partner

We use an industry-leading third-party AI detection engine to power our analysis. Processed versions of your uploaded media are transmitted to our detection service provider solely for the purpose of generating your analysis result. Our detection service provider is contractually prohibited from using your media for any other purpose, including model training. Their services are governed by their own terms and privacy policy.

C. Payment Processing

Payments are processed by Stripe, Inc. (PCI-DSS compliant) for direct web purchases, and by Apple or Google for in-app purchases. RealShield AI does not store your payment card information.

D. Anonymized Metadata

RealShield AI may retain anonymized, aggregated metadata (such as detection probability ranges and general file type information) that cannot be linked to any individual user, for the purpose of improving our internal service quality. This data is not shared with our detection service provider or any other third party for training purposes.

8. INTELLECTUAL PROPERTY

RealShield AI, LLC retains all rights, title, and interest in and to the Service, including all software, algorithms, branding, user interface design, Shield Score methodology, and proprietary technology. These Terms do not grant you any ownership rights in the Service.

"RealShield AI," the RealShield AI logo, and "Shield Score" are trademarks of RealShield AI, LLC. You may not use these marks without our prior written consent.

You retain all ownership rights in the content you upload. We claim no ownership over your media files.

9. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REALSHIELD AI PROVIDES THE SERVICE "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) any Shield Score will be accurate, complete, or reliable; (c) any defects will be corrected; or (d) the Service is free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY DELAWARE LAW AND APPLICABLE FEDERAL LAW:

  • Cap on Damages: RealShield AI's total cumulative liability to you for any claims arising from or relating to these Terms or the Service shall not exceed the greater of (a) the total amount you paid to RealShield AI in the twelve (12) months preceding the claim, or (b) fifty dollars ($50.00).
  • Exclusion of Consequential Damages: RealShield AI shall not be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, or cost of substitute services.
  • No Liability for Detection Errors: RealShield AI shall not be liable for damages arising from false positives (real content flagged as AI-generated) or false negatives (AI-generated content not detected), or for any financial loss, reputational harm, or personal harm resulting from reliance on a Shield Score.
  • No Liability for Third-Party Actions: RealShield AI is not liable for harm caused by scams, fraud, or unauthorized access to your devices by third-party actors.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless RealShield AI, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any privacy, intellectual property, or biometric data right; or (d) any content you upload to the Service.

12. DISPUTE RESOLUTION & ARBITRATION

A. Informal Resolution First

Before initiating any formal dispute, you agree to contact us at support@realshield.ai and give us thirty (30) days to attempt to resolve the dispute informally. Most concerns can be resolved this way.

B. Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in New Castle County, Delaware, or by video conference if both parties agree.

C. Class Action Waiver

YOU AND REALSHIELD AI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Class arbitrations and class actions are not permitted.

D. Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction.

E. Opt-Out

You may opt out of binding arbitration by sending written notice to support@realshield.ai within thirty (30) days of first accepting these Terms. Your notice must include your name, account email, and a clear statement that you are opting out of arbitration.

13. COLORADO AI ACT COMPLIANCE

Effective June 1, 2026, and in compliance with Colorado Senate Bill 24-205 (the Colorado AI Act), RealShield AI discloses that:

  • Our Service uses an artificial intelligence system to analyze digital media and produce probabilistic detection outputs
  • The Shield Score is not a definitive determination — it represents the AI system's confidence assessment and should be interpreted accordingly
  • We conduct ongoing risk assessments of our AI system to evaluate and minimize potential bias or discriminatory outcomes
  • Colorado residents may request additional information about our AI system's design and intended uses by contacting support@realshield.ai

14. APP STORE TERMS

If you download or access RealShield AI through the Apple App Store or Google Play Store, the following additional terms apply:

  • These Terms are entered into between you and RealShield AI, LLC only — not with Apple Inc. or Google LLC. Apple and Google are not responsible for the Service or its content.
  • Apple and Google have no obligation to provide maintenance or support for the Service.
  • In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple or Google, and they may refund the purchase price to you in accordance with their policies. Apple and Google have no other warranty obligation with respect to the Service.
  • Apple and Google are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.
  • Your use of the Service must comply with the Apple App Store Terms of Service and Google Play Terms of Service.

15. TERMINATION

RealShield AI reserves the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms of Service
  • Fraudulent, illegal, or abusive activity
  • Non-payment of subscription fees
  • Any conduct that we reasonably believe harms other users, third parties, or the Service

Upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy. Termination does not relieve you of any payment obligations incurred prior to termination.

You may terminate your account at any time by contacting support@realshield.ai or using the account deletion feature in the app.

16. GOVERNING LAW & JURISDICTION

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Subject to the arbitration provisions above, you consent to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware for any disputes not subject to arbitration.

For users located in the European Economic Area, United Kingdom, or other jurisdictions with mandatory consumer protection laws, nothing in these Terms limits any rights you may have under those applicable local laws.

17. INTERNATIONAL USE

RealShield AI is based in the United States. If you access the Service from outside the United States, you acknowledge that your data will be transferred to, processed, and stored in the United States. Where required by applicable law (including GDPR), such transfers rely on Standard Contractual Clauses (SCCs) approved by the European Commission, not solely on your consent. The United States may have different data protection standards than your country of residence.

18. MODIFICATIONS TO TERMS

RealShield AI reserves the right to modify these Terms at any time. When we make material changes, we will:

  • Send an email notification to your registered email address at least fourteen (14) days before the changes take effect
  • Display a prominent notice within the app
  • Update the "Last Updated" date at the top of this document

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the changes take effect.

19. FORCE MAJEURE

RealShield AI shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, government actions, pandemics, internet outages, or failures of third-party infrastructure providers.

20. SEVERABILITY & WAIVER

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

21. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy (realshieldai.com/privacy), constitute the entire agreement between you and RealShield AI, LLC with respect to the Service and supersede all prior agreements, understandings, and representations.
